Regarding the ambulance case, the Attorney General did not promise you freedom,” the prosecution informed Jakpa

Written by on June 20, 2024

The prosecution in the ongoing ambulance trial has refuted Richard Jakpa’s claims that he provided documents to the Attorney General’s office to aid in the prosecution of Dr. Cassiel Ato Forson, labeling them as false.

Richard Jakpa has alleged that the Attorney General approached him at unusual times to implicate Dr. Ato Forson. In his testimony in court, Jakpa asserted that the Attorney General assured him that, in exchange for his cooperation, he would be granted freedom when the case reaches a decision on the submission.

Based on these purported assurances, Richard Jakpa claims he cooperated by providing documents to support the Attorney General’s case against Dr. Cassiel Ato Forson.

During cross-examination by the prosecution, Director of Public Prosecutions Yvonne Attakora-Obuobisa challenged Richard Jakpa’s assertions, suggesting they were untrue.

The director pointed out to Richard Jakpa that his claim that the Attorney General relied on documents he provided for prosecuting Ato Forson was false.

In his testimony before the court, Richard Jakpa claimed that the Attorney General verbally requested certain documents at Justice Kulendi’s residence, which he subsequently sent via WhatsApp in July 2022.

However, during questioning, Ms. Attakora-Obuobisa countered this by stating that such a scenario was implausible because the Attorney General had already submitted all necessary documents to the court on February 29, 2022, five months earlier. These documents had been disclosed to all parties, including those allegedly sent by Jakpa.

“The Attorney General never utilized any documents you provided because he had already disclosed the documents he intended to rely on for the case. Moreover, he did not acknowledge or consider any documents you sent. Isn’t that the case?” queried Ms. Attakora-Obuobisa during her cross-examination of Richard Jakpa.

Richard Jakpa, however, countered by explaining that while it is acknowledged that the Attorney General filed his disclosures and he also sent documents, the sequence of their submission is inconsequential.

Regarding claims that the Attorney General did not acknowledge the documents, Jakpa clarified that the request was made verbally and the documents were sent electronically, with Godfred Dame personally acknowledging them.

Regarding Jakpa’s assertion that the Attorney General assured him of his freedom during the ruling on the submission of no case, the prosecution pointed to the timeline of their response to the no-case submission in an effort to refute the claim.

Director of Public Prosecutions Yvonne Attakora-Obuobisa pointed out to Richard Jakpa that, despite his assertion that Godfred Dame made this assurance on March 29, 2023, the Attorney General had filed an opposition to the no-case submission on March 12, 2023, arguing that the accused needed to answer the charges.

Ms. Attakora-Obuobisa argued that it was implausible for the Attorney General, who opposed the no-case submission two weeks earlier, to then assure Richard Jakpa that he would not oppose it, thereby ensuring Jakpa’s release.

Richard Jakpa, however, maintained that the Attorney General had indeed assured him that he would not contest his no-case application.
